OSIM (State Office for Inventions and Trademarks) is the national authority in Romania responsible for administering the registration and protection of trademarks, patents, industrial designs, and other forms of intellectual property. 03What types of trademarks can be registered with OSIM?
OSIM allows the registration of several types of trademarks, including: verbal marks (words or combinations of letters and numbers), figurative marks (graphic symbols, drawings or images without text), combined marks (containing both verbal and graphic elements, such as a logo with text), three-dimensional marks (protecting the shape of a product or specific packaging), and sound marks (protecting distinctive sounds associated with a brand).
04How can I check if my trademark is available?
To check trademark availability, a preliminary search can be performed in OSIM’s online database. This search helps identify any identical or similar trademarks that are already registered or pending. Before each registration, TAS Agency verifies the availability of your trademark.
05How long is a trademark registered with OSIM protected?
Trademark protection is valid for 10 years from the filing date. After this period, protection can be renewed for successive 10-year intervals as long as renewal fees are paid. We also offer trademark renewal services to ensure continued protection before the expiration date.
06How long does the OSIM trademark registration process take?
The process may take between 8 and 12 months, depending on the specifics of the application. If there are no oppositions or objections during the substantive examination, registration may be completed more quickly. However, oppositions, incomplete filings, or conflicts with existing trademarks can significantly extend the duration.
07What is the Nice Classification and how is it applied at OSIM?
The Nice Classification is an international system used to group products and services into 45 standardized classes. When filing the application, the applicant must specify the relevant classes for the trademark, as OSIM protection is limited to the selected classes.
08What happens if my trademark is opposed?
If your trademark is opposed by a third party (through opposition or observations), OSIM will analyze all arguments submitted by both sides. Depending on the result of the examination, the application may be rejected, modified, or approved. If the decision is unfavorable, it can be appealed before the competent court.
