FAQ
01What is WIPO?
WIPO (World Intellectual Property Organization) is an international organization dedicated to the protection of intellectual property rights. These include trademarks, patents, copyrights and industrial designs. WIPO facilitates global cooperation in this field and manages international treaties such as the Madrid System for the international registration of trademarks.
02What is the Madrid System?
The Madrid System is a mechanism administered by WIPO that allows trademark owners to obtain international protection through a single application. It covers all member countries of the Madrid Agreement and Protocol. Instead of filing separate applications in each country, the applicant benefits from a centralized and cost-efficient registration process.
03What are the advantages of using the Madrid System?
First, it allows the filing of a single application to obtain protection in multiple countries, eliminating the need for separate national filings. Trademark management is also simplified, as future changes—such as renewal or assignment—can be handled through a single procedure with WIPO.
04How long does the registration process take?
The registration process may take between 12 and 18 months. After filing the application, WIPO verifies the formalities and publishes the trademark in the International Register. Then, the intellectual property offices of the designated countries examine the application and decide whether protection is granted. This timeframe may vary depending on the complexity of the case and national procedures.
05What should I do if I receive a refusal notice?
A refusal notice is issued by a national intellectual property office of a designated country if the trademark does not meet the local legal requirements for protection. If you receive a provisional refusal, you must respond directly to the office that issued it, following its specific procedures. We handle this process for you, preparing legal arguments to increase the chances of approval in that jurisdiction.
06 How long is a WIPO-registered trademark valid?
An international trademark registered through the Madrid System is valid for 10 years from the registration date and can be renewed for additional 10-year periods. Renewal must be requested and paid before the expiration deadline. We manage the renewal process to ensure continuous protection of your trademark.
07Can I add more countries later?
Yes, it is possible to extend the protection of an international trademark to additional countries even after registration. This process, known as “subsequent designation,” involves filing a supplementary request and paying the associated fees. The extension is processed through WIPO.
