FAQ

What does trademark renewal mean?

Trademark renewal is the process by which the owner extends the validity of a registered mark for an additional period, usually 10 years. This process ensures the maintenance of exclusive trademark rights for a new period, in accordance with applicable legislation.

Renewal ensures the continuity of the exclusive rights over the trademark. Without this process, the mark and its legal protection are lost, and the business may be affected by competitors who could use or register a similar mark. In addition, renewal maintains the recognition of the mark among customers and contributes to protecting the brand’s reputation and commercial value.

Our trademark renewal solution ensures the management of all aspects related to extending trademark protection. This includes monitoring deadlines, notifying the owner, preparing the necessary documentation, submitting the application, and tracking the process until completion. In this way, we eliminate risks associated with delays or administrative errors.

During the renewal process, essential modification of the trademark is not allowed, such as changing the design, colors, or other distinctive elements. However, administrative information may be updated, such as the owner’s name or address. If you wish to change the appearance of the mark, you must file a new trademark application.

The duration of the process varies depending on the competent office and its workload. Generally, renewal can be completed within 1–3 months, if the documents are complete and correct. If administrative problems arise or the application is incomplete, the process may be extended.

In many jurisdictions, trademark renewal is allowed during a grace period, which ranges from 6 to 12 months after the expiration date. However, this implies paying additional fees. If the grace period is exceeded, the mark is considered permanently lost and a new application must be filed to regain protection.
