What is the PCT?

The Patent Cooperation Treaty (PCT) is an international system managed by WIPO that simplifies the protection of inventions in multiple countries. A single application allows inventors to request protection in up to 157 member states, avoiding separate national filings at the initial stage.

The PCT system offers a centralised process that reduces initial costs and administrative effort. Inventors benefit from up to 30 months to decide in which countries they want protection and receive an international search report that offers a clear view of the invention’s chances of success.

Not in the strict sense. It is a preliminary application that facilitates later national filings in PCT member countries. Actual protection is granted individually by each country during the national phase according to local law.

The PCT process has two stages. First, the international phase, which lasts around 30 months and includes the international search and optional preliminary examination. Second, the national phase, which begins after 30 months when the application is examined separately in each selected country.

A patent obtained through a PCT application has a standard validity of 20 years in each country where it is granted. The term may be extended in specific fields such as pharmaceuticals or biotechnology.

The international search is carried out by an International Searching Authority (ISA), which analyses the invention to verify its novelty and inventive step. The issued report includes references to relevant patents and publications, giving the applicant a solid basis for deciding how to adapt the application before entering the national phase.
