FAQ

01
What is an OSIM invention patent?

An invention patent is an exclusive right granted by OSIM to its holder, allowing them to use, produce, or commercialize the invention within Romania for a specific period (typically 20 years). In exchange for these rights, the inventor must disclose details about the invention.

Products (such as equipment, machines, devices), processes (manufacturing methods), or new uses of an existing product can be patented. The invention must provide a clear technical solution and be industrially applicable. However, abstract ideas, business methods, or scientific discoveries are not eligible for patent protection.

Through our OSIM patent acquisition service, we offer complete consultancy, professional drafting of documentation, and efficient process management, saving you time and resources. We also support you in extending international protection, ensuring full safeguarding of your invention.

Brevetul este valabil 20 de ani de la data depunerii cererii, cu condiția plății taxelor anuale de menținere. După expirare, invenția intră în domeniul public și poate fi utilizată liber de către orice persoană.

A patent is valid for 20 years from the filing date, provided that annual maintenance fees are paid. After expiration, the invention enters the public domain and can be freely used by anyone.

The registration process usually takes between 2 and 4 years, depending on the complexity of the invention and any objections or corrections required. The examination includes verifying the conformity of documents, assessing novelty and inventiveness, and issuing a technical report.

A prior art search is the process through which OSIM checks the novelty of an invention by analyzing databases to identify similar inventions. A prior art search can be requested before filing the patent application to increase the chances of success and avoid conflicts.

A patent grants the holder exclusive rights to produce, use, sell, or distribute the invention. It may prevent others from using the invention without consent. The holder may also grant licenses or assign their patent rights to third parties.

If you detect an infringement, you can initiate legal action through the competent courts. Actions may include requests to stop unauthorized use, obtain financial damages, and seize counterfeit products.

Yes, you can extend protection by applying for a European patent through the EPO or by filing an international application via the PCT (Patent Cooperation Treaty). These options allow simultaneous protection of your invention in multiple countries.
