What does the renewal of a design mean?

The renewal of a design represents the extension of legal protection for an additional period of 5 years. This process is essential for maintaining exclusive rights over the design, allowing the holder to commercially exploit it and preventing unauthorized use by third parties.

This process is crucial to protecting the investment and effort put into developing the design. Renewal maintains the exclusivity of use and allows the owner to take action against any third party attempting to use or exploit the design without consent. Additionally, continuing protection contributes to strengthening the brand and maintaining a competitive advantage in the market.

Protection for a registered design is initially valid for 5 years and can be renewed multiple times, up to a maximum of 25 years in 5-year intervals. It is recommended to renew before the expiration date to maintain uninterrupted protection. If the protection period expires, in some cases a grace period of up to 12 months may apply, but additional fees will be charged.

If you do not renew the design before the protection period expires and not even within the grace period, the rights over that design are permanently lost. This means the design becomes part of the public domain, allowing other individuals or companies to use or register it without needing your permission.

The duration of the process varies depending on the intellectual property office and the accuracy of the submitted documents. In general, renewal is completed within 1–3 months, but in more complex cases or when administrative errors occur, the procedure may take longer. It is recommended to file the renewal request as early as possible to avoid delays.

In most cases, renewal is still possible during the grace period, which may range between 6 and 12 months from the expiration date. However, this involves paying additional fees. If the grace period ends, the design can no longer be renewed and becomes part of the public domain, meaning a new registration request will be required to regain protection.
