What is a Registered European Design (REuD)?

A Registered European Design (REuD) is an intellectual property right that grants protection for the external appearance of a product. It protects characteristics such as shape, contours, colors, texture, or the materials of the product, valid in all 27 EU member states. This protection applies exclusively to visible elements during normal use.

Registering with EUIPO offers uniform protection across the entire European Union through a single administrative process. This saves time and costs compared to filing individual applications in each country. Holders can prevent unauthorized use and take legal action against infringement in all 27 member states, protecting both commercial value and visual identity.

To be eligible, a design must be new—meaning it has not been previously disclosed to the public before filing—and must have individual character, creating a distinct overall impression compared to existing designs. Novelty and individual character are essential for obtaining protection.

You can generally protect any product, including packaging, furniture, vehicles, jewelry, electronics, clothing items, and component parts. Protection applies only to visible aspects, not technical function or internal features.

Design protection is initially granted for 5 years, with the possibility of renewal for successive 5-year periods up to a maximum of 25 years. Renewal must be filed before each expiration date; TAS Agency can manage this process for you.

Yes, EUIPO allows multiple-design applications, where several designs can be filed under a single application—even if they belong to different product classes according to the Locarno classification. This flexibility, introduced by Regulation (EU) 2024/2822, reduces administrative costs and simplifies management of multiple designs within one procedure.

Public disclosure occurs when a design is made accessible to the public before the application is filed. At EUIPO, there is a 12-month grace period during which disclosures made by the design holder do not affect the novelty requirement. It is essential that the design has not been used or published earlier than this period.

Registration grants the holder exclusive rights over the design, allowing them to prohibit unauthorized use, reproduction, sale, or distribution of the design by third parties. These rights apply throughout all EU member states, protecting the design against counterfeiting.

If you detect an infringement, you can send a cease-and-desist letter to stop unauthorized use and, if necessary, initiate legal action in court. Although EUIPO does not intervene directly, registered design protection facilitates legal enforcement and anti-counterfeiting measures.
