FAQ

01
What types of creations are protected by copyright?

Copyright protects any original creation expressed in a tangible form, such as books, poems, melodies, films, photographs, paintings, sculptures, architecture, software, or databases. Even digital works, such as videos uploaded on online platforms, are protected as long as they are original and do not infringe the rights of others.

Copyright protection is automatic when a work is created and expressed in a tangible form. However, officially registering the work with a competent authority, such as OSIM or the Copyright Office, is recommended to facilitate proof of ownership in case of disputes. Registration also provides an official reference point for the creation date.

We offer personalized services, including official copyright registration, monitoring the use of your work online, identifying infringements, and managing disputes. We also assist with licensing processes, drafting customized contracts, and managing your copyright portfolio to maximize the commercial value of your creations.

Copyright offers two main types of protection: moral rights and economic rights. Moral rights include the author’s right to be recognized as the creator of the work and to protect its integrity. Economic rights allow the author to commercially exploit the work, offering exclusive rights to reproduction, distribution, adaptation, or publication.

Although copyright is acquired automatically, registering the work provides formal proof of ownership and creation date. Other methods include keeping drafts, manuscripts, or original files along with metadata indicating the creation date. Registration with a timestamping service or notarization can also constitute valid evidence in court.

If you notice an infringement, the first step is to collect clear evidence, such as screenshots, files, or other materials. Next, you can send a cease-and-desist letter requesting the infringer to stop using your work. If the infringer does not comply, you may initiate legal action to obtain financial compensation, an injunction, or other enforcement measures. TAS Agency can help you navigate the entire process and defend your copyright effectively.

Copyright infringement may lead to civil and, in some cases, criminal sanctions. Civil penalties include compensation for financial losses caused to the rights holder, the withdrawal and destruction of products that infringe the rights, and the prohibition of unauthorized use. In severe cases, such as large-scale counterfeiting, more serious penalties may apply.

Copyright can be transferred or licensed to individuals or legal entities through a written contract. For example, you can sell the copyright in your book to a publisher or transfer the rights in a script to a film studio. Moral rights, such as the right to be recognized as the author, cannot be transferred but can be exercised with the author’s consent.

A copyright licence agreement is a contract through which the rights holder grants another person or entity the right to use the work for specific purposes, such as publication, distribution, or reproduction. The agreement sets out the terms and conditions of the licence, including its duration, territory, whether the rights granted are exclusive or non-exclusive, and the remuneration owed to the rights holder.
