What is an appeal before OSIM?

An appeal before OSIM is a legal procedure through which an interested party requests the review of a decision issued by OSIM. Such decisions may concern the refusal of a trademark application, the rejection of an opposition, the invalidation of a mark, or other outcomes related to existing trademark rights. Through the appeal, the party seeks to modify or annul the decision by demonstrating procedural, legal, or evidential errors.

Appeals may target decisions such as: refusal of trademark or design registration applications, rejection of oppositions, cancellation or invalidation of marks, as well as other administrative decisions that impact intellectual property rights.

After the appeal is filed, OSIM analyses the documents and notifies the opposing party, if applicable. The opposing party has the opportunity to respond to the arguments raised in the appeal. Afterwards, the OSIM appeals committee evaluates the case based on the arguments and evidence submitted, and ultimately issues a reasoned decision.

The resolution of an appeal can take between 6 and 12 months, depending on the complexity of the case, the workload at OSIM, and the number of responses or additional documents requested by the appeals committee. In complex cases, the process may exceed this timeframe.

An opposition is a procedure by which the registration of a trademark application is contested before it is approved, based on conflicts with earlier rights. An appeal, on the other hand, is a procedure that seeks the review of an already issued OSIM decision. In practice, opposition is preventive, while an appeal intervenes after a decision has been made.
