When we talk about design protection at the EUIPO, most entrepreneurs think of physical products such as furniture, clothing, packaging or accessories.<\/p>\n

In fact, in a previous article I presented the most common categories of products registered as design with the EUIPO<\/strong>, which you can consult here.<\/a><\/p>\n

Today, however, we turn our attention to a lesser-known category of creations. The European design protection system is much more flexible than many entrepreneurs think, and some of the most valuable visual elements of a business can benefit from protection without the owners realizing it.<\/p>\n

Here are 7 examples of creations that can be registered as designs with the EUIPO and that often surprise business owners:<\/p>\n

  1. Graphical interfaces of digital applications and products<\/strong><\/li>\n<\/ol>\n

    Today, many products are rated by users not only by functionality but also by the visual experience they provide.<\/p>\n

      When we talk about packaging, we usually think of the external appearance of the box or container.<\/p>\n

      However, the inner structure of the packaging can also be protected. Cardboard inserts, special compartments, product holders or elements that create the “unboxing” experience may constitute distinct designs.<\/p>\n

      These elements are often copied by competitors because they contribute both to the presentation of the product and to its protection during transport.<\/p>\n

        Many entrepreneurs believe that protection is granted exclusively to the product as a whole. In reality, certain components can be registered separately.<\/p>\n

            Large retail chains invest considerable amounts in creating distinctive visual experiences for customers, and design protection can prevent competitors from imitating them.<\/p>\n

              Icons used in apps, software, or online platforms are often the result of a complex creative process. An original set of icons can be registered as a design, giving the holder the opportunity to prevent its reproduction by competitors.<\/p>\n

              For technology companies, these graphic elements are part of the product identity and contribute significantly to the user experience, which is why it is worth looking into the possibility of protecting them.<\/p>\n

                Consumable products can also benefit from design protection. For example, the embossed design of a chocolate bar, the design printed on a candle or the decorative elements applied to stationery may be registered with EUIPO.<\/p>\n

                Even if the product is consumed or used for a limited period, its visual appearance can be an important differentiator from the competition and deserve legal protection.<\/p>\n
